As she had warned she might do, a special prosecutor appointed to handle the domestic-violence case of Athens County Commissioner Mark Sullivan has asked a judge to revoke Sullivan’s probation from an earlier case, and put him in jail.
Meigs County Prosecutor Colleen Williams was appointed to handle a case in which Sullivan, 52, is charged with having “head-butted” his 29-year-old niece during a domestic dispute the night of Jan. 10. Sullivan was arrested by Nelsonville Police; he has pleaded not guilty to the charge.
Unfortunately for Sullivan, however, when the incident occurred he had already taken a plea in an earlier domestic-violence case dating from 2011, in which he was alleged to have hit his wife at their Millfield home. The couple are now divorced.
In that case, Sullivan pleaded to a reduced charge of persistent disorderly conduct, paid a $250 fine, and was required to perform community service. He was given 30 days in jail as well, but this was suspended on condition he remained a law-abiding citizen for two years, paid the fine, completed the community service, and completed a domestic violence intervention program.
His January arrest may have violated the terms of his jail suspension, however. Last week, Williams filed a motion asking Athens County Municipal Judge William A. Grim to revoke the suspension, and require Sullivan to serve his 30 days in the regional jail.
A hearing on the issue is scheduled for Feb. 24. If Grim does revoke the jail suspension, this could mean that Sullivan, who is up for re-election and faces four opponents in the March Democratic primary, could be behind bars during the primary election.
Williams is a former assistant prosecutor in the Athens County Prosecutor’s office.
It's sad that a "Special prosecutor" would ignore the simple rule of law, "Innocent until proven guilty." Otherwise, I've no opinion. Wasn't there, didn't hear it, didn't see it.
Simply getting arrested is a violation of the probation because clearly, he wasn't abiding by the law. If this were me, I would have STILL been sitting in jail. I'm sick of people in Athens Co. getting special treatment because of who they're related to, or what they do in the community.
