A Wisconsin company that owns a number of mall properties in Athens has filed a lawsuit to evict Gran Ranchero, a Mexican restaurant, from its home at 979 E. State St.
The suit, filed in Athens County Common Pleas Court last week by the Continental 113 Fund LLC, claims that the restaurant has failed to pay its monthly $5,000 rent for the last three months, and therefore has defaulted on its lease.
Contacted Sunday, the manager of the restaurant said he could not comment on the suit, and referred questions to the owner, Raul Morales of Parkersburg, W.Va. The Athens NEWS was unable to locate contact information for Morales.
The complaint says that Continental 113 Fund notified Gran Ranchero of its alleged lease default in a letter Nov. 14. Based on the alleged default, it says, the company has a legal right to throw the restaurant out of the site immediately.
The restaurant has been told to leave, the suit says, but so far has failed to do so.
In 2009, Continental 113 Fund sued a former mall business located near Gran Ranchero, claiming it had abandoned its building and owed back rent.
In that suit, the Fund claimed that Hollywood Video, once located at 959 E. State, had stopped paying on its lease, pulled its operations out of the building, and owed more than $19,000 in unpaid rent.
In that case, the business's parent company, Movie Gallery, Inc., had filed for Chapter 11 bankruptcy in a federal court in West Virginia.
